1. Introduction

These Terms of Service ("Terms") govern access to and use of OrbitScraper, including our website, dashboard, Search Engine Results Data API, and related services.

By creating an account or using the service, you agree to these Terms.

2. Description of the OrbitScraper Service

OrbitScraper provides a SERP Data API and search analytics infrastructure that returns structured search engine results data for software products, analytics workflows, and market research use cases.

3. User Responsibilities

You must provide accurate account information and keep credentials and API keys secure. You are responsible for all activity under your account.

You are responsible for ensuring your data usage complies with applicable law, contractual obligations, and third-party platform terms. OrbitScraper does not authorize unlawful access or misuse of data.

4. API Usage and Rate Limits

Access is provided through API keys with plan-based limits, including requests per minute, monthly credits, and concurrency thresholds.

We may apply technical safeguards and fair-use controls to protect service stability and other customers.

5. Acceptable Use Policy

Use of OrbitScraper must comply with our Acceptable Use Policy. The Acceptable Use Policy is incorporated into these Terms by reference.

6. Prohibited Activities

• Collecting sensitive personal data without lawful basis
• Violating third-party terms or access restrictions
• Credential harvesting, phishing, spam, or abuse
• Unlawful monitoring, surveillance, or fraud
• Interfering with the security or availability of the service
• Using the service for illegal activities

7. Payments and Billing

Paid plans are billed in advance on a recurring basis. Credit top-ups are prepaid and applied to your account balance.

Subscriptions renew automatically unless canceled before the next renewal date. Cancellation takes effect at the end of the current billing period unless otherwise required by applicable law.

For certain transactions, OrbitScraper may use a merchant-of-record payment partner. In those cases, the merchant-of-record is the seller of record to the buyer and may process checkout, billing, invoicing, subscription renewals, cancellations, refunds, and applicable taxes in accordance with its checkout terms and applicable law.

You authorize the applicable merchant-of-record or payment provider to charge the fees, taxes, and renewal charges associated with your selected plan or purchase.

Refund handling is governed by our Refund Policy.

9. Intellectual Property

OrbitScraper and its software, documentation, branding, and platform components are owned by OrbitScraper and protected by applicable intellectual property laws.

10. Service Availability Disclaimer

The service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted operation, specific uptime outcomes, or error-free performance.

11. Limitation of Liability

To the maximum extent permitted by law, OrbitScraper is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption.

12. Termination

We may suspend or terminate access for violations of these Terms, non-payment, or security risk. You may stop using the service at any time and cancel renewals from your account settings.

13. Governing Law

These Terms are governed by the laws of India. Courts located in Pune, Maharashtra, India will have jurisdiction over disputes, subject to applicable law.
